Privacy Policies and  Data Collection

Apex English Tutoring is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

      The type of information collected

​​Apex English Tutoring receives, collects and stores any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.

We also collect personally identifiable information (including name, email, password, communications), comments, feedback, product reviews, recommendations, and personal profile. Payment details (addresses, phone numbers, credit card numbers/bank account numbers) are not collected or accessible.

      How information is collected

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.


Payment providers such as PayPal and other entities used on this site, have their own privacy disclosures.

      Why personal information is collected

Apex English Tutoring collects such Non-personal and Personal Information for the following purposes:


To provide and operate the Services;
To provide our Users with ongoing customer assistance and technical support;
To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;
To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 
To comply with any applicable laws and regulations.

      Privacy policy updates

Apex English Tutoring reserves the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

     Warranties and Limits to Liability

Apex English Tutoring  ('we', 'us', 'our') is dedicated to making our Services the best they can be, but we're not perfect and sometimes things can go wrong.

You understand that our Services are provided "as is" and without any kind of warranty (express or implied).

We are expressly disclaiming any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade.

We do not guarantee that:

​

(i) the Services will be secure or available at any particular time or location;

(ii) any defects or errors will be corrected;

(iii) the Services will be free of viruses or other harmful materials; or

(iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.

​      Liability Limits

To the fullest extent permitted by law, neither Apex English Tutoring, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the Services of these Terms. In no event shall Apex English Tutoring's aggregate liability for any damages exceed the greater of one hundred ($100) US dollars or the amount you paid Apex English Tutoring in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.

       Refunds and Returns

 

Apex English Tutoring, despite the inference in its business name, does not offer online or offline teaching of English itself nor does it offer courses or classes, either in-person or online.

Instead, we offer (in one self-contained, self-teaching lesson) what is essentially an ebook accompanied by other digital resources (MP3 audio files) to teach customers/clients/students 'simply better' Methods or ways to practice their skills (grammar, vocabulary, listening, writing and speaking, spelling, and pronunciation to gain greater fluency in English. 

 

Due to the nature of digital content, we do not offer refund requests or accept returns.

 

We assume that the customer/client/student understands that the content is written in English, and to be able to understand that content, she/he must have some ability to read simple English. Inability to comprehend all or any part of the content is not a reason to warrant a refund.

In addition, because each Module is a standalone Lesson, where the Method is taught in the one lesson, unlike a series of classes as part of an ongoing course, no trials, or samples of the (unique)  Methods, can be offered.

Customers are responsible for ensuring compatibility with their devices and reviewing product details before completing transactions. Click on the Method to read about it.

Any issues arising from technical difficulties or dissatisfaction with the content do not warrant refunds.

 

By proceeding with the purchase, customers expressly waive their right to claim refunds or returns, understanding that digital products are non-returnable and non-refundable.

 

This policy is an integral part of the terms and conditions governing transactions on our platform.
 

Intellectual Property Rights over Software and Content

The intellectual property rights in all software and content made available to you on or through this Website remain the property of Apex English Tutoring or its licensors and are protected by copyright laws and treaties around the world.

All such rights are reserved by Apex English Tutoring and its licensors.

You may store, print and display the content supplied solely for your own use.

​

You are not permitted to publish, manipulate, distribute, or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

You shall not modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on any software or accompanying documentation supplied by Apex English Tutoring or its licensors.

"Let me help you to the top" and My "simply better" Methods are trademarks belonging to Apex English Tutoring. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are similar in colour without the written permission of Apex English Tutoring.

Working with Children

Apex English Tutoring does not offer courses (or My 'simply better' Methods) for children under 13 years of age.

I prefer to teach adults.

I do have a current Working with Children Card.

But I do not offer courses targeted to children under 13 years of age even if they have parental consent..
